Wedding Booking Terms & Conditions


In the following terms & conditions “the photographer” shall mean Alexander Irving Spurr or Stacy Ann Spurr or both trading as Stacy Irving. “The client(s)” shall be those persons booking the photography session on the booking form. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.


Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing.


Image Delivery

Your online gallery of low resolution images will be made available to you as soon as the images are edited. This will normally be before the delivery of the high resolution images which may take 4 -6 weeks to be delivered.


Website Display & Promotional Usage


The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.


The photographer will aim to keep these photographs safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than Stacy Irving employees.


Photographic Images


Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.


For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.


The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.


Weather, Force Majeure or Act of God


In the event of weather causing limitations to the types of photography offered and final images the Photographer will not be liable.


The photographer will endeavour carry out the booked service but in the event they are unable to attend due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.


Law


These Terms and Conditions shall be governed and construed in accordance with the Laws of England.


Liability


The Photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit.


Personal Accident Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.


Licence


The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.


On the Day & Booked Hours


The photographer is the only authorised and official photographer for your wedding day.


Bridal preparation to first dance is 9 hours coverage. Depending on your wedding timings, additional hours in excess of 9 hours will be charged at our additional hours rate of £50. If for reason of delay or other the key components of the photography package fall outside of the booked hours then the photographer reserves the right to submit an invoice for the additional hours charges at £50 per hour and images will not be released until payment.


The earliest the photographer will work on any wedding day is two hours before the ceremony and the latest shall be 9.00pm unless agreed otherwise in writing prior to the wedding.


A meal for the photographer(s) must be provided if the full day coverage is requested.


Photograph Prints


All photograph and image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct. All photographs supplied by Stacy Irving are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. Stacy Irving cannot accept any responsibility for this gradual image deterioration. All pictures purchased are presumed to have been received in good condition unless the Client notifies Stacy Irving in writing of any discrepancy or error within 14 days of receipt following which Stacy Irving will take the issue up with any 3rd party supplier of the photographic product.


Booking Fee


A non-refundable booking fee is charged when the client agrees this contract, this fee is deducted (in full) from the total price. The booking fee secures the time and services of the photographer for the wedding and is non-refundable in the event of cancellation.


Payment


The outstanding balance (minus the booking fee) is due to be paid one calendar month before the wedding date.


Cancellation by the client


In the unfortunate event that you have to cancel your booking you will be offered the opportunity to rebook and the deposit transferred to that date if due to unforeseen circumstances.


If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon cancellation:

• Cancellation with more than (or equal to) 100 days to go until the wedding
date, the booking fee of £100.00.
• Cancellation with less than 100 days to go until the wedding date, full price
for the complete photographic coverage booked.


The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

Where the photographer is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the booking fee.


Refund Policy


The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.


Retouching


Retouching and artist finishing is available as an optional extra and the final output and finish of any image that is re-touched will be at the photographer’s discretion.


Original digital images are kept on an active file for three months, after which time the raw images are stored in a secure location (access to these images is solely limited to the photographer) and theses may be deleted after 12 months.


Complaints


Any complaints should first be raised by the client with the photographer in writing within 21 days from the date of receipt of images.
The Photographer reserves the right to amend these Terms and Conditions without prior notice.
